Terms and Conditions

I. Basic provisions 1. These Terms and Conditions are issued in accordance with Section 1751 and following of Act No. 89/2012 Coll., Civil Code of the Czech Republic. RH GASTRO s.r.o., Company ID: 27076261, VAT ID: CZ27076261, registered office Proutěná 415/31, Prague 149 00, registered at the Municipal Court in Prague, Section C, File 94479, email info@highenergybar.cz, phone +420608002020, www.highenergybar.cz (hereinafter “Seller”). 2. These terms regulate the rights and obligations between the Seller and a natural person who concludes a purchase contract outside their business activity as a consumer or within their business activity (hereinafter “Buyer”) through the website interface of the online shop. 3. These terms form an integral part of the purchase contract. 4. The contract is concluded in the Czech language. II. Information about goods and prices 1. Information about products including prices and main characteristics is provided in the online shop catalogue. Prices include VAT and all related fees. 2. Product presentation in the online shop is informative and does not constitute a binding offer. 3. Shipping costs are listed in the online shop and apply only within the Czech Republic. 4. Discounts cannot be combined unless agreed otherwise. III. Order and conclusion of contract 1. Costs related to remote communication are borne by the buyer. 2. Orders can be placed through a customer account or without registration. 3. The buyer selects goods, quantity, payment and delivery method. 4. Before sending the order the buyer can check and edit entered data. 5. After placing the order the buyer receives an automatic confirmation email. The purchase contract is concluded only after order acceptance by the seller. 6. If the seller cannot fulfil the order he may send a modified offer. 7. Orders are binding but may be cancelled before confirmation. 8. The seller is not obliged to deliver goods at an obviously incorrect price caused by technical error. IV. Customer account 1. Registration allows the buyer to access a personal account. 2. The buyer must provide correct and updated information. 3. Login credentials must remain confidential. V. Payment and delivery 1. Payment may be made by bank transfer, card payment, payment gateway, cash on delivery or personal pickup. 2. Delivery costs are paid together with the purchase price. 3. The seller issues a tax document (invoice). 4. Ownership of goods passes to the buyer after full payment and delivery. VI. Withdrawal from contract 1. Consumers have the right to withdraw within 14 days. 2. The withdrawal period begins on the day of receipt of goods. 3. Exceptions are defined by the Civil Code. 4. Goods must be returned within 14 days. 5. The seller refunds payments within 14 days. VII. Rights from defective performance 1. The seller guarantees that goods are free from defects upon receipt. 2. If a defect appears within 6 months it is presumed to have existed at delivery. 3. The buyer may request replacement, repair, discount or withdrawal. VIII. Delivery of documents 1. Communication between parties may occur electronically. IX. Out-of-court dispute resolution 1. Consumer disputes are handled by the Czech Trade Inspection Authority (COI). X. Final provisions 1. Legal relations are governed by Czech law. 2. Website content is protected by copyright. 3. The seller is not liable for interference by third parties in the online shop. 4. The contract is archived electronically and is not publicly accessible. 5. The seller may change these terms and conditions. These terms come into force on 1 November 2024.
